These Terms of Service ("Terms") govern your use and access to the websites, goods, and services ("Products"). Please carefully read these Terms & Conditions and contact us if you have any issues. You agree to be bound by these Terms and our Privacy Policy by accessing or using our Products. 

Hayllo has the right, at any time, to update or modify these Terms (including our policies that are incorporated into these Terms). It is highly recommended that you read these terms regularly. By continuing to use the Platforms after the updated Terms are posted, you will be assumed to have consented to the amended Terms. 

i. Use of Hayllo

You may enter a binding agreement with Hayllo and use our products only in accordance with these terms and all relevant laws. When creating a Hayllo account, you must provide accurate and complete information. Anyone under the age of 13 is not permitted to use or access the website. If you are opening an account on behalf of a company, organization or other legal entity, you represent and warrant that "you" includes you and that organization and you have the right to grant all sets of rights and licenses. As set forth in these Terms and Conditions, the Organization is bound by these Terms and you are accepting these Terms on behalf of the Organization. 

Please provide personal information such as a valid email address, mobile phone number and unique password when creating an account. Depending on the payment method you choose, you may need to provide your credit card details to purchase your order. Your unique password should not be shared with anyone, and you agree to keep it a secret. You are responsible for keeping your password secure. You accept that all orders placed through your Hayllo account are your sole responsibility, except in the case of fraud or abuse for which you are not responsible. 

Hayllo is not responsible for orders that have delivery problems as a result of insufficient, inaccurate or missing information you provide. You must provide complete, accurate and true information for the proper processing of your order, including shipping address and contact information. 

If you would like to delete your Hayllo account, please let us know by email. We may limit, suspend, or terminate your use of your Hayllo account and / or platform if we reasonably believe that someone else has unauthorised access to your Hayllo account or if we suspect or discover that you have engaged in any activity or behavior that is in violation of these Terms, our policies and guidelines, or if, in our sole discretion, you engage in any activity or behavior that constitutes an abuse of the Platform.

ii. Security Term

We care about the safety of our users. While we strive hard to keep your material and account secure, Hayllo cannot promise that unauthorised third parties will never be able to bypass our security measures. Please contact us immediately if your account has been compromised or unlawful usage has occurred.

iii. Intellectual Property

Trademarks, names, logos and service marks displayed on this website (collectively, "Trademarks") are registered and unregistered trademarks of the website owners. No Content, Trademarks or any part of the Site may be used, reproduced, copied, sold, resold, made available, modified or used in whole or in part for any purpose without our prior written consent.

iv. Product Restrictions

Certain products offered on our platform are subject to purchase restrictions (“Restricted Products”) in accordance with the applicable laws of the country in which the restricted products are purchased. These limits include minimum age requirements for alcoholic and other goods that we have the right not to ship to you in accordance with applicable legal requirements. 

You must be of legal age to purchase alcohol. Hayllo, the seller and its suppliers, in their sole discretion, reserve the following rights from time to time to ask you to provide valid proof of age (IC number) prior to delivering alcohol. We refuse to deliver if you cannot prove that you have reached the age for legal alcohol usage.  

v. Ordering & Shipping

Whenever an order is placed with Hayllo, Hayllo will send a confirmation email with a receipt for the order. Your order may include all applicable taxes (Goods and Services Tax etc)  

Hayllo is under no obligation to provide information about ingredients or allergens on the platform. In addition, Hayllo does not warrant that the products it sells are allergen-free. If you have allergies, allergic reactions or dietary restrictions and requirements, please contact us before placing an order on our platform.

vi. Time of Delivery

Hayllo will ship the order to the shipping address you provide. You can choose shipping slots by date and time for your purchase. A confirmation email will be provided for estimated delivery times, however delivery times may vary due to factors beyond our control (order quantity, distance, time of day (peak periods), weather conditions, traffic conditions, etc.).  

When you click on 'My orders' on the Platforms, you can view the remaining delivery time of your order. You agree that the delivery times we provide are approximate timings as orders may arrive sooner or later than the indicated timing. To avoid missing a delivery of an Order, make sure that you or someone else is at the delivery location to accept the Order.

vii. Delivery Failure

If we attempt to ship your order but are unable to deliver for any of your reasons, such as no one was around to accept the orders or an attempt was made to contact the customer using the phone number provided, but the customer could not be reached or lack of adequate or sufficient access for successful delivery of the order or lack of a suitable or safe place to keep or leave an order or the receiver does not meet the legal age requirements or upon delivery as it is deemed unsafe or unsuitable for the receive to accept items that are restricted. 

viii. Wrong Order, Missing Product, Defective Product

After receiving your order, if you have any problems with your order (wrong order, defective order, or missing items), please contact customer service by WhatsApp at +6010-2877022 or email at [email protected]. Hayllo may request photo evidence and additional information for investigative purposes. If we conclude that the order or product you received is not up to par in terms of the condition or quality, we will refund or exchange your order/items.

ix. Order Cancellation

If you wish to cancel your order after it has been placed, please contact us through our support team via WhatsApp immediately at +6010-2877022. You may cancel your order if we have not yet accepted and confirmed your order.

ix. Payment Options

Hayllo retains the right, in its sole discretion, to implement new payment methods or discontinue current payment methods at any time. Your money will be processed by our third-party payment service provider(s) if you choose to process payments online. With your permission, we will keep your credit card / payment information with our third-party payment service provider(s) for future orders on our platform. Hayllo does not keep any of your credit card or payment information. 

You must ensure that you have enough money on your credit and debit cards to complete payment of an Order. Hayllo accepts responsibility for payments made on our Platforms insofar as they are needed, including refunds, chargebacks, cancellations, and dispute resolution, providing they are fair and justifiable and in line with these Terms.

x. Photographs

All photos provided are only for illustrative purposes. Without previous warning, the photos may be updated or changed.

xi. Packaging of The Product

Manufacturers have the right to change their package and ingredient lists at any time. The packaging of our products may change from what is shown on https://hayllo.co and our social media platforms.

II. Representations, Warranties & Liability Limitation

i. Warranties & Representations

You recognise and agree that the material on the Platforms is given "as is" and "as available," and that any use or dependence on the Platforms, as well as any information, goods, services, or resources accessed or received via them, is at your entire risk and judgment. While Hayllo takes reasonable measures to ensure that the Platforms and the products we provide are constantly available, we do not promise or represent that the Platforms will be delivered in a secure, timely, continuous, error-free, and virus-free manner. Please expect short Platform disruptions due to planned or routine system maintenance, downtime caused by internet or electronic connections, or situations of unforeseen circumstances.

ii. Liability Restrictions

To the fullest extent legally permitted, Hayllo (including its staff, directors, representatives, legislators, affiliates, and parent company) disclaims all liability (whether in agreement, negligence, or other) for any damage or loss you or any related parties may suffer in correlation with our Platforms, services, and any website linked to our Platforms and any content or information posted on it. Your sole and exclusive remedy in relation to your use of the Platforms is to stop using them. The Hayllo organizations, their employees, distributors, and service providers will not be responsible for any indirect, exceptional, incidental, compensatory, or exemplary damage resulting from your use of the Platforms, or for any claim relating to your use of the Platforms in any manner. 

These exemptions for indirect, particular, consequential, and exemplary damages include, without limitation, damages for lost profits, lost data, loss of goodwill, loss of work, general strike, computer malfunction or operator error, or any other commercial harm or losses, even if the Hayllo entities, their agencies, legislators, and service providers were made aware of such loss or damages and regardless of the valid legal theory upon which claim is premised. Since some states or jurisdictions do not enable the omission or liability for incidental or consequential damages, the Hayllo organisations, its representatives, legislators, and service providers' responsibility shall be restricted to the extent permitted by applicable law in such states or jurisdictions.

iii. Protection of Personal Data (Personal Information)

You accept and consent to Hayllo and any of its associated organisations collecting, storing, processing, and sharing your Personal Data in line with these Terms and our Privacy Policy. Our Privacy Policy is accessible via links on our Platforms and is incorporated into these Terms.

iv. Indemnity of Hayllo

You agree to protect, defend, and agrees to indemnify Hayllo, its executives, officers, staff, representatives, agents, and associates from any and all third-party claims, responsibility, damages, and/or costs (including, but not restricted to, legal fees) originating from your use of the Platforms or violation of these Terms.

v. Websites And Links From Third Parties

The Platforms may include connections to third-party sites, and by using these hyperlinks, you consent to do this at your sole discretion. Hayllo has no influence over or endorsement of any third-party sites or connections, and is not liable for the contents of these connected pages. Hayllo assumes no duty or responsibility for any damage or loss you may incur as a result of your access to and use of these third-party links and sites.

vi. Termination of Hayllo Account or Access

Hayllo reserves the right to remove, revoke, as well as delete your account and access to the Platforms, along with any courier service we offer to you in connection with an Order, for just any purpose. Without limitation, if Hayllo, in its sole discretion, considers your use to be unacceptable, or if you violate the Terms, Hayllo may, but is not obligated to, give you with a notice prior to terminating your usage of the sites.

vii. Legals

If any term of these Terms of Use is declared to be illegal by a court of competent jurisdiction, the legality of the other parts of these Terms of Use shall not be affected, and they shall continue in full force and effect. No waiver of any term in these Terms of Service shall be construed a subsequent or continuing waiver of that or any other provision.

These Terms will be regulated and construed in accordance with Malaysian law and the laws of any future related countries.
